Italian Legal Document Translation

English translations of Italian court, notarial and comune records, and Australian documents translated into Italian for use in Italy.

Italian legal documents we commonly see

Many of our Italian legal jobs relate to family history, property and inheritance in Italy, alongside court documents from separations and divorces. Civil status records are kept by each Comune through its Ufficiale dello Stato Civile, while court matters pass through the Tribunale, the Corte d'Appello and the Corte di Cassazione.

What makes Italian legal documents tricky

Italian separates separazione from divorzio, and a divorce judgment may be headed cessazione degli effetti civili del matrimonio rather than using the word divorce at all. We translate the heading exactly so the reader sees which proceeding the document belongs to. Italian legal style uses very long sentences built around formal openings such as visto, considerato and P.Q.M. (per questi motivi), and we keep the structure so the translation can be checked line by line.

Married women usually keep their birth surname on official records, so a mother's name on a birth extract may differ from the name she uses in Australia. Older records are often handwritten in registers and may use archaic spellings or abbreviations. Each person also has a codice fiscale, which is reproduced as shown.

English into Italian for use overseas

Australian documents are regularly needed in Italy: powers of attorney for selling inherited property, divorce orders to be recorded by a Comune, statutory declarations and documents for citizenship by descent. We translate them into formal Italian. Italian offices and consulates often specify an apostille or a sworn translation process of their own, so check with them before you order.

Preparing Italian documents

A Comune can issue civil status documents in several formats: a full copy (copia integrale), an extract (estratto) and a certificate (certificato). They contain different details, so check with the body you are submitting to which one they want before you request it from Italy. Multilingual extracts on the international form already carry printed English labels, but we still translate the entries and every stamp. Scan court documents with all stamped pages included.

Translation, not legal advice

We translate what your documents say. We do not advise on their legal effect, and we cannot confirm whether a particular court or agency will accept them. Please check requirements with the receiving body or your lawyer.

Frequently Asked Questions

Can you translate old handwritten Italian civil records?

Yes, provided the scan is legible. Words that cannot be read are marked as illegible rather than guessed.

Do you translate Australian powers of attorney into Italian?

Yes. Upload the document and tell us that it is for use in Italy. Check with the notary or office in Italy whether it also needs an apostille.

Why does my Italian divorce document not say divorce?

Italian divorce judgments are often titled cessazione degli effetti civili del matrimonio or scioglimento del matrimonio. We translate the title as written; for what it means legally, please ask a lawyer.
